Black Forge Art Terms & Conditions

We hope your visit to our website, online store and/or workshop is enjoyable. Please read the below terms and conditions carefully, if you have any questions please contact a member of the team.

Visiting Our Workshop

Please read before leaving your vehicle.

Visits are welcome during working hours (Monday – Friday 9am-5pm). However, due to the nature of our work and the potential for us to be away for an on-site installation we always recommend calling or emailing ahead and booking an appointment to avoid any disappointment.

Please note that we do not currently have a show-room of our work. The only examples you would be able to see is what we are currently working on or recently finished ready for delivery to our customers. Please call ahead if you are interested in anything in particular and we will let you know when something similar is scheduled for work.

Our workshop is a building within an active farm. When entering the farm always be aware of farm traffic and moving machinery, especially when exiting and entering your vehicle.

We manufacture metal artwork. – This means welding, grinding and machinery being used during working hours. Please approach the workshop with caution and wait by the front doors until welcomed by one of the team.

We do not take any responsibility for any injury sustained within our premises or on site.

Once on site a strict 5pm speed limit is in place for yours, ours and the farm workers safety.

Parking is directly outside the workshop main entrance. Alternatively, please park next to the trees opposite. Please ensure the track is left clear at all times for farm traffic to pass.

Dogs are welcome, the exception being that they must remain outside the workshop and kept on a lead at all times as our workshop is on an active farm. The floor of the workshop is not always clear of metal debris and we do not take responsibility for any injury of your pet while on site.

Most areas outside and around the workshop have uneven ground.  Please be mindful of this and wear appropriate footwear. Visiting the workshop is at your own risk, we do not take any responsibility for personal injury or for loss/damage to personal possessions.

Our first aid point is located in the container to the left of the workshop, please notify a member of staff who will escort you there.

Toilets are located 200m away from the workshop, next to the main farm office. Disabled toilet facilities are available.

Children must be supervised at all times outside the workshop. Unfortunately, children under the age of 18 are not permitted entry into the workshop.

Please abide by on-site health and safety messages.

We reserve the right to restrict entry of the workshop at our discretion.

Due to the recent and potential ongoing COVID-19 pandemic, we reserve the right to alter our admissions protocols to react to the latest guidance and situations at any time, which may be during or just before your visit.

Other entry restrictions may revolve around uncourteous or impolite behaviour or inappropriate clothing’s or the lack of the same.

Again we reserve the right to restrict or deny entry and use our discretion to evaluate all circumstances as they arise.

Site traffic must not exceed 5mph.

Responsibility cannot be taken for any possessions left unattended anywhere on site.

Terms & Conditions For Items Purchased Online, In Store & By Phone 

In these terms and conditions of sale the expression “The Company” or “Company” means Black Forge Art. And the “Purchaser” means the company, firm or persons to whom the goods are supplied by the Company under this contract.

No description of goods by the company in any leaflet, catalogue or other written matter shall constitute a contract of sale of goods by description for the purposes of the Sale of Goods Act 1893 and the Sale of Goods Act 1979.

1.0 General Lead-Times

All of our work is handmade to order so there is a little wait while we make your order for you. Workload levels during a given year varies which means our lead-times can also vary.

Unless otherwise specified on the individual products description our current Lead-Time estimate from time of order to completion of all shop products is – 6 weeks. This depends on the individual product and current work demand. This is an estimated time and we do not offer any guarantee on this time unless specifically discussed with the customer.

Christmas Lead-Times

We will ensure that all online sales of products placed on or before December 1st will arrive before Christmas. 

Special Occasions and deadlines

If you order is a gift then please inform us of any special occasions and dates to ensure this is achievable before placing your order. We will always try and ensure that we can meet a deadline and will confirm if this is possible with you before you place your order. We will contact you as soon as your commission is complete to arrange the soonest delivery. Please see delivery section for details on our delivery service

1.1 Lead-Times on bespoke designs

A Lead-Time on bespoke commissions and designs would be quoted at time of enquiry/order and depends on our designers current workload. A live update on this time can be estimated by contacting us.

2.0 Guarantees

Any guarantee mentioned on the site or these terms only applies to products where this is stated. If a product is found to be defective within the timeframe offered (from the date of the order), we will replace that part, either whole or part and deliver it to the customer. The Guarantee ONLY applies to the metal components of the product (not the finish or painting) and only for products when the guarantee came into effect. This does not affect your statuary rights.

If no guarantee is specified on a product then a 1-year guarantee would apply.

2.1 ‘Stainless Steel Collection’ 15 year guarantee

Buy with confidence with our impressive 15 year guarantee on all products clearly listed as part of the ‘Stainless Steel Collection’.

If a product is found to be defective within the timeframe offered (from the date of the order), we will replace that part and deliver it to the customer. The Guarantee ONLY applies to the metal components of the product (not the finish) and only for products when the guarantee came into effect.

All qualifying products of this guarantee will be automatically registered from the date of purchase.

This guarantee covers:

Any signs of rust/corrosion on the entire commission for 15 years.

Any breakage of welds or failure of parts for 15 years.

Improper function of the products intended use for 15 years.

We do not cover for:

Paintwork and/or finishing.

Damage caused by mistreatment or misuse of the product other than its intended function.

Damage due to an insecure fixing to an unsuitable structure or failure due to unsuitable fixings.

Please note this list is not exhaustive and only includes some of the most common consequences.

3.0 Product images, variations and listings

Due to the handmade nature of goods, items may differ to the images shown on the website and/or on other printed material. The customer understands that different monitors, screens and printers can render colours differently and that these variations are not a fault of the product itself. The customer accepts the potential of this arising. 

Any reference to weights and dimensions or performances contained in any catalogue, leaflet or other written matter by the company are approximate only and shall not constitute an implied term of this contract.

Customers are reminded to satisfy themselves that the goods they are purchasing are suitable before completing an order. No responsibility is placed upon the company for making an incorrect order.

4.0 Delivery Information:

Please note the information below is on the delivery of our products once they are manufactured and ready for shipping. Please reference ‘Lead-Time’ section 1.0 above for currently estimated manufacture time of commissions. 

Any delivery note signed in an unclear fashion or undated by the Purchaser (recipient) has to be taken as correct, the Purchaser has a responsibility to sign for material in full, full signature/full printed name and dated.

You agree that proof of delivery will constitute one of the following:

A recipient signature if the item is delivered to your address

A recipient signature if the item is delivered to a neighbouring address

A photograph showing the item left on your property

A drop card stating the item has been left with a neighbour or on your property

When an order has been placed and accepted, the Purchaser must ensure that someone is available at the given delivery time and address to accept the goods and sign the delivery note. Failure to do this will result in the goods being returned to the Purchaser’s local delivery depot, whereby, a card will be posted through the Purchaser’s door. The Purchaser must follow the directions regarding a subsequent attempt at delivery or may choose to collect from the said depot. If the Purchaser chooses not to respond to these directions, or contact the said depot, the parcel will be returned to Black Forge Art and the Purchaser will then need to arrange collection at their own cost from Black Forge Art. We advise that no arrangements are made with tradesmen or contractors until the Purchaser has received the goods, they are in their possession, and they are fully satisfied.

We recommend all items are checked thoroughly upon arrival to ensure everything is accurate and present. This must be done before shipping on to a further destination. Additional packing materials may be required. We cannot take responsibility for items which may have been lost in transit.

We do not recommend proceeding with installation preparation until items have arrived safely and you are completely satisfied.

The company accepts no liability or responsibility for loss of earnings or any charges that may be incurred due to non-delivery or late delivery. Delivery dates are always subject to change and therefore we strongly advise that no arrangements are made until you have received the goods and are fully satisfied. The company urges patience from its customers regarding all deliveries, especially during annual and bank holidays.

Delivery of large and cumbersome items may occasionally be ‘vehicle side only’ and may require unloading directly by the customer. In such cases where there is a failed delivery or where delivery is proven to be obstructed by the customer, the company reserves the right to cancel the order minus any costs incurred.

Due to the automatic nature of the carriage calculation system, we reserve the right to contact the customer and alter the carriage cost if the real cost is significantly higher than the carriage automatically calculated and charged. The customer would then reserve the right to cancel the order in full. If you feel there is an error in the delivery calculation at the check-out please contact us before placing your order.

Estimated delivery times once your order is completed of manufacture and packaged ready for shipping:

We make NO GUARANTEES on delivery times, these are all estimated.

4.1 UK Deliveries

Once your order is manufactured and collected from us by the carrier it will arrive the following day (in most cases). Our next-day service is trackable.

Please note that some areas of Scotland could experience a two-day delivery service.

4.2 Europe and the rest of the world:

Delivery outside of the United Kingdom may incur an additional delivery surcharges than displayed by our online automated delivery calculations. This will be related to the size, weight and type of product that is being shipped.

For delivery outside of the U.K we suggest you either place the order in the normal way or contact us before placing your order. We will then contact you or inform you of any additional charges (if any) and apply this to your order. You will then be able to either accept or cancel your order based on these charges. You can also contact us for a full quote before placing your order.

We can ship to most countries, if you cannot see your country on our list please email us: info@blackforge.co.uk.

For international shipments we use DHL, UPS or FEDEX ‘by air/road’ service this is a fully tracked and signed for service, below we’ve broken down how long by days it’ll take for your package to get to you. Please note this breakdown is a guide and may not be exact if you live in a rural area you may find your package takes a day longer to get to you and in some cases it may take less.

2 Days – Northern Ireland, France, Germany, Chanel Islands – UK, Belgium, Luxembourg, Netherlands

3 Days – Austria, Denmark, Finland, Italy, Portugal, Spain, Sweden

4 Days – Bulgaria, Czech Republic, Greece, Poland, Hungary

5 Days – United States of America, Australia, Brazil, Canada, China, Greenland, Hong Kong, South Korea, Iceland, Japan, New Zealand, Norway, Russia, Singapore, Switzerland, South Africa, Taiwan

As our work is handmade to order we typically operate a no return policy as most custom-made work does not present re-sale opportunities. We encourage our customers to ensure selections are made correctly before confirming the order.

The exceptions for this would be a full return and refund if Black Forge Art has the potential opportunity of resale of purchased item. This would be at the discretion of the company only. These returns would need to be within 28 days of delivery and the product would still be in its delivered state (I.e. has not been installed, fitted and then removed). 

Black Forge Art would let all customers know if a product purchased online would be accepted for a return so please contact us before ordering if they is any possibility that you would request a return.

If we have granted a full return the customer would be responsible for return costs of the product (whether with couriers arranged by Black Forge Art or customer allocated shipping).

If we have granted a full return a full refund will be issued to the same details payment was made within three working days of receipt of goods.

Communication must be made by email, online contact form or letter. We recommend dating letters.

Should a product arrive faulty we ask the customer to immediately photograph the delivery box and damaged/faulty product and email or write to us (please date letters). If harm or damage is at no fault of the customer or responsible parties of the customer the company will arrange full return and repair or remanufacture before delivery back to customer at no cost to the customer.

Before installation or use of an item, it is the customer’s responsibility to ensure that they are happy with the item. If you are not entirely satisfied with your item, you must notify us immediately. You must not rework or correct the product without our explicit agreement in writing. If rework is undertaken without written agreement, we cannot be held responsible for any issues and the item can no longer be returned to us.

In the unlikely event of a product becoming faulty after installation/fitting, we cannot be held responsible for any costs associated with deinstallation and it becomes the customer’s responsibility to organise the safe return of said item. If you become dissatisfied about an installed product, you must contact Black Forge Art immediately to discuss your concerns before sending any items back to the company. Once approved and agreed upon by the company, we will then advise whether the item needs to be returned to us in order to rectify the issue. In some cases, we will send out materials or parts to rectify the issue (e.g. touch-up paint, etc). If a return is required, you must arrange and cover all financial implications to return the item in full without any harm or loss of parts. Thereafter, we will evaluate if any rework is necessary or if a refund in full or part can be actioned.

Regardless of whether an item has been delivered damaged, is faulty or incorrect, for all returns, it is the customer’s responsibility to ensure it is safely and suitably wrapped for courier collection and must also be made available in the same location as the courier delivered it.

Disposal of all packaging, including pallets, etc. is the customers responsibility.

None of these terms change or alter the terms of any guarantees.

5.1 Delivery Damage Returns

We can only process a delivery damage return within 72 hours of delivery. So please ensure your delivered item has been thoroughly checked within this time.

Please include photos of the packaging, any damage, and your order number. For returns please contact us by email or letter.

For all delivered products and items, we recommend inspecting the goods prior to accepting and signing for them from the courier.

It is the customer’s responsibility to thoroughly check delivered goods before any installation is undertaken. 

Regardless of whether an item has been delivered damaged, is faulty or incorrect, for all returns, it is the customer’s responsibility to ensure it is safely and suitably wrapped for courier collection and must also be made available in the same location as the courier delivered it, or at the kerbside of the property. For palleted items, please ensure that you retain all packaging. Should you wish to return an item, it will need to be repackaged as best you can use the pallet supplied. In the event that packaging isn’t retained, you will be incurred the respective cost as quoted to us by the courier. This cost will be reduced from the refundable value of your item. Collections must be available within courier working hours, typically 7 am -7 pm.

5.2 Commissions and bespoke product returns

Dissatisfaction of handmade commissions that have been individually manufactured as per a customers request are not eligible for returns as they would not be available for re-stocking.

Bespoke work would include but not limited to to; Individual commissions, a variable product and signage that includes lettering of a property.

We do not offer returns on our work once a commission has been made as each order is individually made by hand for the customer.

Please ensure that you have double checked the options and ordered correctly or contact us if you need any clarification or advice before you order.

If you have made an error with your order then please contact us and we will adjust this for you, including refunding or charging according to the adjustment required. – If we have already started work on your commission then this may not be possible so please contact us immediately if you require any changes to your commission.

5.3 Cancellations

You can cancel your order within 72 hours of ordering and receive a full refund by contacting us.

We can extend this time for a full return of retail price if we have not commenced any work on your commission.

If some but not all work has commenced and 72 hours have lapsed a partial refund can be issued.

Please note that any cancellations of commissions that have been completed of manufacture would not receive any return of costs or payments.

Please note that all refunds will be only credited back using the original payment method.

6.0 Our rights

Whilst any money remains outstanding by the Purchaser to the Company, title to all goods (under any contract) shall remain vested in this company. This Company may recover any goods upon demand and shall resell at our own discretion. The Purchaser shall hold such goods as trustee for this company and any resale of the goods by the purchaser shall not involve the passing of title from this company unless and until the goods have been paid for in full.

All prices shall be subject to increase in the event of increases in wages or raw materials occasioned by government act or regulation and any other relevant increase occurring before completion of any order. 

We reserve the right to remove certain products from offers without notice.

We reserve the right to refuse any order for any reason. We also reserve the right to cancel any purchase (an order already accepted by us) in (amongst others) the following situations, without being liable for any damage or costs:

• Your billing information is not correct or not verifiable.

• Your order is flagged up by our security systems as an unusual order or an order susceptible to fraud.

• A pricing error

• We could not deliver to the address provided.

Should we cancel an order a full refund will be credited back using the original payment method within three working days

6.1 Incorrect pricing and listing information

Our sale of goods agreement is not formed until the goods are dispatched successfully to the customer. Up until dispatch, if an item is under-priced or mispriced as a genuine mistake, the Company reserves the right to cancel an order or offer you the item at the correct price. At this point, you have the option of proceeding at the correct price or cancelling the order.

7.0 Installation, & Post-Installation Of Our Products

Always instruct a professional to install our commissions.

We are not responsible for any costs or damages associated with a product’s use, misuse or incorrect installation, whether the product is faulty or otherwise.

Black Forge Art is not responsible for any loss, damage or injury in any form associated with the purchase and/or supply of goods, whether the product is faulty or otherwise.

8.0 Image & Content Use

28. Due to significant investment made in the designing and also photography of our products each year, the right to use any image which belongs to “The Company” is forbidden unless granted by request in writing. Acceptance of image use would be granted formally by email or letter. Use of imagery includes the website, print or any other medium. We recommend, for peace of mind, that the images are deleted from your computer system and any printed literature removed from distribution. All content/copy and product information under any circumstances remain the property of “The Company”.

Any third party or company using our designs, images or content for any profit-making ventures would be liable to prosecution by the company. All requests for whatever reason to use any imagery or content on this website or originated from the company must be made in writing. 

Bespoke, made to order and custom products, whereby the product has been manufactured or ordered to the customer’s specification are non-refundable and non-returnable. Prototypes are chargeable unless otherwise agreed and must be returned after inspection and approval.

The company reserves the right to use bespoke and made to order products and/or requested designs by an individual or company for further promotion and/or sale. The original customer of a bespoke design can request the design to not be used other than its original purpose. However, the rights of produced imagery will remain with the company.

9.0 Website Discount Codes

The company reserves every right to not deliver orders where the discount code has been misused on products it was not originally intended for or a genuine error. We will contact the customer regarding this and request that the outstanding balance is paid before the goods are released for delivery. Alternatively, the order can be cancelled and the full amount paid returned to the customer. 

10.0 Payment Methods

Cheque: –Once the cheque has been received by ourselves, we will have to wait until the cheque has cleared before we can send any of your items out to you.

Credit/Debit Cards: – We accept all major credit and debit card payments. Both in-person and online.

BACS: – We also facilitate bank transfers from your bank account to ours using a pro forma invoice.

11.0 Ex-Display & Clearance Products

Occasionally we will offer limited products that have had a prior use, either as a display item or for other promotional material.

Product listings, as featured on the website as part of the clearance shop, are subject to change according to availability and stock levels. These items are sold as seen on the products photograph. Please read the descriptions thoroughly as these items may also include defects and differ from guarantees shown on similar shop listings. Any product in less than perfect condition would be clearly noted in its description.

We prefer personal collection of these products. However, delivery is also available.
